Terms of Service

These Terms of Service ("Terms") govern your use of the LoanFlow platform operated by SkyLution Technologies. By registering for, accessing, or using LoanFlow, you enter into a binding agreement with us. If you are using LoanFlow on behalf of an institution, you represent that you have the authority to bind that institution to these terms.

• By accessing or using LoanFlow, you agree to be bound by these Terms of Service
• If you do not agree with any part of these terms, you may not access or use our services
• We reserve the right to update these terms at any time. Continued use constitutes acceptance of changes
• These terms are governed by the laws of the Republic of Kenya

• You must be at least 18 years of age to register for a LoanFlow account
• You agree to provide accurate, complete, and current registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorised use of your account
• We reserve the right to suspend or terminate accounts that violate these terms

• Loan applications are subject to credit assessment and approval criteria
• Interest rates, fees, and repayment terms are disclosed at the point of application
• You agree to repay all borrowed amounts plus applicable interest and fees on time
• Late payments may attract additional fees and negative CRB reporting
• We reserve the right to adjust interest rates with 30 days' written notice

• Using the platform for any unlawful purpose or in violation of Kenyan law
• Attempting to gain unauthorised access to our systems or other users' accounts
• Submitting false or misleading information in loan applications
• Using the platform to launder money or finance illegal activities
• Reverse engineering, copying, or distributing our software without authorisation
• Engaging in any activity that disrupts or interferes with our services

• LoanFlow provides the platform 'as is' without warranties of any kind, express or implied
• We are not liable for indirect, incidental, or consequential damages arising from use of our services
• Our total liability shall not exceed the total fees paid by you in the 12 months preceding the claim
• We are not responsible for service interruptions beyond our reasonable control
• We do not guarantee that loan applications will be approved or funded

• Any disputes arising from these terms shall first be resolved through informal negotiation
• If negotiation fails, disputes shall be resolved through mediation at a mutually agreed venue in Nairobi
• Unresolved disputes shall be referred to the exclusive jurisdiction of the courts of Kenya
• These terms are governed by the Laws of Kenya, including the Banking Act and the Data Protection Act
